Abortion Ban Trial

JAMA. 2004;291(14):1690. doi:10.1001/jama.291.14.1690-c

A trial on the constitutionality of a ban on what abortion foes call "partial birth" abortion began March 29 in a federal court in Manhattan. The case began when the National Abortion Federation sued US Attorney General John Ashcroft, calling for him to stop enforcement of the abortion restrictions that were signed into law by President Bush last November.

The trial will revolve around whether the procedure is ever necessary to ensure the health of the mother. If the law stands, physicians performing certain abortions could face 2 years in prison.
